PUBLIC OFFER

for the conclusion of a distance sales agreement for goods

1. General Provisions1.1. This document is an official public proposal (offer) of an Individual Entrepreneur (hereinafter referred to as the “Seller”) operating through the website https://usheniina.com (hereinafter referred to as the “Website”) and contains the terms for purchasing goods by distance selling.
1.2. In accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine, this document constitutes a public agreement.
1.3. Placing an order on the Website constitutes the Buyer’s full and unconditional acceptance (acceptance of the offer) of the terms of this Offer.

2. Subject of the Agreement2.1. The Seller undertakes to transfer ownership of the goods presented on the Website to the Buyer, and the Buyer undertakes to pay for and accept the goods under the terms of this Offer.
2.2. The name, assortment, characteristics, and price of the goods are indicated on the Website.

3. Placing an Order3.1. Orders are placed by the Buyer independently through the form on the Website.
3.2. The Buyer undertakes to provide accurate personal information necessary for order fulfillment.
3.3. The Seller has the right to refuse to process an order if incomplete or inaccurate information is provided.

4. Price and Payment Procedure4.1. All prices on the Website are indicated in the national currency of Ukraine — hryvnia (UAH).
4.2. Payment is made online using Visa/Mastercard bank cards through the WayForPay payment service.
4.3. Payment processing is carried out in accordance with the rules and security standards of the payment system.
4.4. The Agreement is considered concluded from the moment the successful payment is confirmed.

5. Delivery of Goods5.1. Delivery is carried out by Nova Poshta in accordance with the conditions specified on the “Delivery” page.
5.2. Delivery times depend on the region and the selected delivery method.
5.3. The risk of accidental damage or loss of the goods transfers to the Buyer from the moment the goods are handed over to the carrier.

6. Returns and Exchanges6.1. Returns or exchanges of goods are carried out in accordance with the legislation of Ukraine and the conditions specified on the “Returns and Exchanges” page.
6.2. The Buyer has the right to return the goods within 14 calendar days from the moment of receiving them.

7. Rights and Obligations of the Parties
7.1. The Seller undertakes to:

• provide accurate information about the goods;
• transfer goods of proper quality;
• ensure the protection of personal data.

7.2. The Buyer undertakes to:

• provide accurate data when placing an order;
• pay for the order in a timely manner;
• accept the goods.

8. Liability of the Parties8.1. The Parties bear liability in accordance with the current legislation of Ukraine.
8.2. The Seller is not responsible for delivery delays caused by the carrier or force majeure circumstances.
9. Force Majeure9.1. The Parties are released from liability for failure to fulfill their obligations in the event of force majeure circumstances.

10. Final Provisions10.1. The Seller reserves the right to make changes to this Offer without prior notice.
10.2. The current version of the Offer is always published on the Website.
